  1. Legally Binding Contract: By signing a contract with Let It Shine Exteriors, LLC (also referred to as “we”, “us”, “our”, “our company”, and “Let It Shine Exteriors”), you (also referred to as “you”, “your”, “customer”, “client”, “homeowner”, “owner”, and where applicable your household, employees, tenants, agents, builders, vendors, contractors, and assigns – collectively, the “parties”) are signing a legally binding contract for work to be completed at an agreed-upon price. If you breach this contract, Let It Shine Exteriors reserves the right to retain all deposits.

  2. Scope of Work: The work and services to be performed are those expressly agreed upon on the document, estimate, quote, or proposal provided to you by paper, internet, email, or verbal conversation. This document, estimate, quote, or proposal is valid for 30 days. Any document, estimate, quote or proposal accepted either verbally or by signature (hand-written or electronic) will be subject to the Terms and Conditions herein. Additions requested by you will be added to the contract as an additional charge. Please read and/or understand the document, estimate, quote, or proposal completely to be sure each service you require is accounted for. If not, ask us to make an amendment, and communicate your service request. Let It Shine Exteriors has the right to refuse service at any time, whether or not a contract has been signed. If we refuse service, and a deposit was made, the deposit will be refunded. Any of our services may not be provided on outstanding accounts. We reserve the right to amend or terminate any introductory, promotional or referral promotion at any time without notice. Terminated accounts will not re-qualify for any introductory offer if the account is re-opened.

  3. Payments: Payments to Let It Shine Exteriors are due the day the job has been completed for residential customers, and within 30 days the job has been completed for commercial customers. Payments are to be paid by cash, check, or credit card. If you have a great experience with Let It Shine Exteriors, feel free to leave a tip. Tips are appreciated! If paying by credit card, a processing fee may apply to the total. Late charges will be immediately assessed on all balances not paid in accordance with contract terms. We reserve the right to make a surcharge in the case of exceptionally dirty surfaces to be cleaned, or hard to access areas where service will be performed. Let It Shine Exteriors reserves the right to place any unpaid account in collection. In the event of a dispute over payment, it is the clients responsibility to prove that payment in full has been made and cleared. You agree to pay all collection costs, court costs, late fees, filing fees, interest, administration, debt recovery fees, and attorney fees applicable by law.

  4. Water Usage: You agree to provide Let It Shine Exteriors the right to use an on-site water supply as needed to complete the stated project without compensation. It is your responsibility to make sure the water supply is on and in working order before we arrive. Additional charges may apply if water is not available.

  5. Electrical Usage: You agree to provide Let It Shine Exteriors the right to use an on-site source of electricity as needed to complete service without compensation for such use. Additional charges may apply if exterior electricity is not available.

  6. Removal & Replacement of Items: Unless otherwise arranged ahead of time, it is your responsibility to remove and replace furniture, plants, grills, decorations, electronics, and any other items from patios, decking, and other exterior surfaces scheduled for cleaning. Removal, protection attempts, or replacement of these items by Let It Shine Exteriors will be an additional charge. Let It Shine Exteriors is not responsible for damage to items moved. You must completely remove any outdoor televisions and accessories (speakers, wires, other electronics etc.) before our arrival.

  7. Removal & Replacement of Signage: You shall remove or adequately protect all exterior signage or similar exterior objects that could be damaged due to exposure to water, chemicals, solutions, cleaning elements, etc. Additional charges may apply for the removal/protection/replacement of these items.

  8. Safety and Courtesy: While Let It Shine Exteriors is on-site, you are responsible for keeping yourself, children, other individuals, and animals away from the work areas and off the work surfaces. Do not open doors, garage doors, or windows while we are working.

  9. Weather & Rescheduling: Weather and employee health conditions are an important factor in our work environment and may prevent us from performing service on the scheduled date and time. We try our best to keep re-scheduling and scheduling conflicts to a minimum; however, we may need to reschedule work due to rain, wind, lightning, other weather-related conditions, and even employee health conditions that arise and are beyond our control. You will be promptly notified of any such changes.

  10. Damages: You must ensure that all items to be cleaned are structurally sound prior to cleaning. We are not responsible for aged, weathered, or prior damage. By agreeing to have the worked schedule, you are ensuring all items are in good condition. Let It Shine Exteriors is not responsible or liable for damages caused by loose, cracked, opened, un-removed, unprotected, broken, faulty, defective, aged, weathered, rotting, damaged, or malfunctioning foundations, walls, roofing, framing, siding, gutters, fascia, soffit, doors, garage doors, windows, fans, electronics, plants, grass, furniture, seals, weather stripping, gaskets, drywall, trim, framing, flashing, caulking, plumbing, electrical sources, receptacles, switches, fixtures, fans, any type of wiring, HVAC, carpentry, paint, stain, sealant, etc. Also included are their associated items/objects such as hardware, accessories, attachments, materials, equipment, machinery, instruments, mechanisms, tools, appliances, or devices. We will not be responsible for loose mortar that may dislodge during the cleaning process. Any water leaking or drainage into, onto or around the structure like at doors and windows is the sole responsibility of the customer, this includes seals around windows and doors. Let It Shine Exteriors is not responsible for any faulty wiring or electrical issues that present themselves during or after a service. We highly recommend the customer turning off the breaker to all exterior electrical outlets prior to our service(s) and leaving them off for 24 hours to give all outlets and wiring the opportunity to dry. Accordingly, you hereby hold Let It Shine Exteriors harmless for any damages to your property, structure, surfaces, or improvements that result from our service(s). We are not liable for any consequential or incidental damage, or for any loss resulting from defects as noted.

  11. Watertight: Your property should be in good repair, weathertight, and appropriately sealed and/or caulked. This includes, but is not limited to, electrical services (receptacles, switches, wiring, light fixtures, etc.), roofs, doors, and windows. Let It Shine Exteriors services is not responsible for damages due to water, chemicals, solutions, cleaning elements, or any other liquid infiltration from poor or improper installation, maintenance, or repair. On the day(s) of service, all windows and doors must be closed before cleaning.

  12. Concrete: After it is cleaned, concrete’s appearance will vary due to a number of factors, but mostly from when the concrete was initially poured and cured. When concrete with dirt, mold, mildew, algae, other pollutants and/or stains is cleaned, the surface may reveal imperfections that the pollutants and stains have covered up. You understand that not all concrete will look the same after cleaning, even concrete on the same driveway, patio, sidewalk, or other concrete surfaces. Although pressure washing / power washing will remove most stains from concrete surfaces, some marks and/or stains may not be removed by this process.

  13. Stains: The following cannot be removed by our services: tree sap, artillery fungus, ivy suckers (vine feet), splatters from stains and paints.

  14. Window Cleaning: Outside Windows: Screens must be removed from the inside prior to arrival or there is an additional charge of $4 per screen to remove. Exterior window cleaning does not include sill cleaning. We will not clean any windows we consider to be inaccessible or unsafe on the day of the clean. We will not attempt to provide service through unsafe working practices. We do not use ladders over 28 feet and do not climb on certain roofs which may be deemed unsafe.

    Inside windows: It is your responsibility to ensure that windows are accessible and sills and other surfaces are cleared beforehand.

    Every effort will be made to clean on the appointed day, although we reserve the right to alter the day without notice due to unforeseen circumstances. If you are not home upon our arrival, we can begin service as long as screens do not need to be removed from your windows. Also, if inside work is needed or if screens need to be removed from the inside, we can not wait more than 15 minutes for someone to arrive home. We apologize for this however, waiting more than 15 minutes is a domino effect for the rest of the customers scheduled for the day.

  15. Tempered Glass Waiver: You release Let It Shine Exteriors from any liability on tempered glass or heat strengthened glass scratching during the cleaning process. Due to widespread problems with poor quality tempered glass scratching during window cleaning, we will not be liable for any scratches on any tempered or heat strengthened glass. It is accepted and understood by ALL parties that properly used razor blades and scrapers are standard tools and techniques for construction window cleaning and can safely remove limited amounts of construction debris (plaster, paint, texture, tape, stickers, etc.) from quality glass, without scratching the glass surface. Furthermore, it is accepted, the use of razor blades and scrapers will be employed on all window cleaning and no other cleaning method will be offered by us to remove construction debris from any glass surface. If Builder/Customer does not choose to have window cleaner use razor blades or scrapers, Builder/Customer must cover all glass during entire construction process, which would protect the glass from any construction debris and eliminate the need for Let It Shine Exteriors to use razor blades and scrapers to clean the glass. This clause must be included on all contracts. If this clause is not acceptable, there is no contract between Let It Shine Exteriors and Builder/Customer. By accepting this estimate/proposal you agree to this waiver fully and agree that Let It Shine Exteriors is not liable for any consequential or incidental damage or scratches on any tempered or heat strengthened glass, or for any loss resulting from damages, defects, and scratches as noted.

  16. Gutter Cleaning: Gutter cleaning is restricted to removing matter from within the gutters and does not include the removal, repair or replacement of any part of the gutter or downspouts.

  17. Window Spotting: Windows may become spotted (hard water spots) due to minerals in your water source (if spotting was not already present). To ensure your windows have no spots, ask for our professional pure water window cleaning service for an additional charge.

  18. Oxidation: In every aluminum siding case, and in some vinyl siding cases, the sun and weather will bleach the color of the siding and cause fading. Removal of the chalky, gritty, fading, or failing surface materials may cause parts and/or portions of the vinyl or aluminum to stand out. Let It Shine Exteriors will not be responsible for such conditions. Any exterior aluminum has a dark oxidation that comes with aging. Even when these surfaces are cleaned, this oxidation will be removable at times and non-removable at others. Let It Shine Exteriors offers no guarantee or price reduction in this case. Occasionally, paint will come off the gutter exteriors during cleaning due to oxidation and/or organic matter having eaten completely through the paint. Let It Shine Exteriors is not at fault in this case as there is no way to tell which gutters this will happen to.

  19. Failings in Paint Tints & Pigments: There are sometimes changes and/or failings in paint tints and pigments which show up after exposure to our cleaner and/or cleaning process. Sometimes this issue is in an inconspicuous place, but occasionally the problem may show up in isolated areas well into the cleaning process. Blue and brown paints are the most notorious for having tinting and pigment changes and/or failing issues — blues tend to turn green, and browns tend to turn yellow; however, this issue is not limited to blue and brown paints only. Let It Shine Exteriors is not responsible for paint manufacturer defects, or for tinting or pigment changes and/or failings that appear during our cleaning process.

  20. Work stoppage: If work must be stopped while the job is in progress, due to changes by customer or unforeseen defects or delays on the customer’s part, the customer will pay for labor time incurred. If the situation can be remedied on the job by the contractor, he will do so with customer’s consent and a signed waiver. Full access is required on the day(s) of the clean. We are unable to move any obstacles which may inhibit cleaning. Should partial access on the scheduled day(s) reduce the extent of the clean, we reserve the right to charge 100% of the scheduled clean.

  21. Photos and Video Footage: You give Let It Shine Exteriors permission to use any photos and video footage of the areas we are cleaning for the purpose of advertising and marketing. This includes using the photos and/or video footage on the internet, social media, and our website.

  22. Promotions and/or General Information: By providing Let It Shine Exteriors personal information (name, address, phone number, email, etc) for your anticipated or chosen service, you agree to us mailing or emailing you to inform you of various offers we are promoting, or general information we deem fit to share with you.

  23. Questions, Concerns, Complaints, Disputes, and Issues: Your satisfaction is important to us. If any questions, concerns, complaints, disputes, or issues arise after our service(s) are performed, please contact us via phone or email within 72 hours of your scheduled service. Anything received after 72 hours of our scheduled service with you will not be considered. All disputes are covered by Florida law and under the jurisdiction of Escambia County Courts only.

  24. Change to Terms and Conditions: Let It Shine Exteriors reserves the right to change the Terms and Conditions at any time without notice.

Let It Shine Exteriors Holiday Lighting Agreement

The parties agree to the following terms:

This agreement (also referred to as “contract”, and likewise vise-versa) outlines the terms in which Let It Shine Exteriors agrees to serve as your holiday lighting installer for the term listed below. This is a lease agreement for the holiday season for material, labor, maintenance, and storage. The following terms and conditions apply to all sales and services provided by Let It Shine Exteriors.

1) Legally Binding Contract
By signing or otherwise evidencing your acceptance of service with Let It Shine Exteriors (also referred to as “we”, “us”, “our”, “our company”, and “Let It Shine Exteriors, LLC”), you (also referred to as “you”, “your”, “customer”, “client”, “homeowner”, “owner”, and where applicable your household, employees, tenants, agents, builders, vendors, contractors, and assigns – collectively, the “parties”) are entering a legally binding agreement for service to be completed at an agreed-upon price. If you breach this agreement, Let It Shine Exteriors reserves the right to retain all deposits.

2) Estimates
Estimates (also known as quotes or proposals) are only valid for 30 days from the date of their creation and while all efforts are made to guarantee the quoted price, no estimates are guaranteed until both parties sign and/or otherwise evidence acceptance of a determined total price. Current prices of materials, labor, and other related expenses dictate estimate totals and are subject to change.  If changes occur to any of the above-mentioned costs such that we can no longer perform the work at the estimated price at the time the customer is ready to sign, we will provide an updated estimate.  In this event, the previous estimate is void. A signed or otherwise accepted estimate by the customer (verbally or in writing) giving Let It Shine Exteriors the approval to commence work is considered a legally binding agreement.

3) Discounts
Most customers we install lights for have us come back year after year. As a result, we offer one-, two-, and three-year agreements. Discounts are available for two- or three-year terms unless the total price after the discount is applied is less than our company minimum. Two-year agreements save 10% on the total price, while three-year agreements save 20% on the total price. We will be reaching out to our contract customers in October for the 50% deposit to get you on the schedule for the season. The balance is due 48 hours before installation.  Contract customers are given priority for scheduled dates. Dates are on a first-come, first-serve basis.

4) Payments
The customer agrees to pay Let It Shine Exteriors the total cost of the agreed upon estimate each year. A non-refundable deposit of 50% is required for us to schedule an installation date. Any remaining unpaid balances are due, and to be paid, 48 hours before the scheduled installation date each year. If not paid for in full, the installation will be re-scheduled to the next available date. The customer acknowledges that all deposits are non-refundable. Payments are to be paid by cash, check, or credit card. If you have a great experience with Let It Shine Exteriors, feel free to leave a tip. Tips are appreciated! If paying by credit card, a processing fee may apply to the total. Late charges will be immediately assessed on all balances not paid in accordance with the agreement terms. We reserve the right to make a surcharge in the case of exceptionally hard to access areas where service will be performed. Let It Shine Exteriors reserves the right to place any unpaid account in collection. In the event of a dispute over payment, it is the customers responsibility to prove that payment in full has been made and cleared. You agree to pay all collection costs, court costs, late fees, filing fees, interest, administration, debt recovery fees, and attorney fees applicable by law.

5) Electricity
You agree to provide Let It Shine Exteriors the right to use an on-site source of electricity as needed to complete service without compensation for such use. You must provide clear access to safe and adequate electricity commensurate with the volume of lights requested. We will require enough free circuits to successfully handle the electrical load of the lighting package. Let It Shine Exteriors will not be held responsible for inadequate, faulty, or overloaded electrical sources at the place of service. If circuit breakers frequently need to be reset, this is often an indication of inadequate power supply and may require an outside service call to locate additional clean circuits and redistribute power. Customer may be required to provide electrical connection from inside the house. Customers requesting large lighting packages may need to consult with their electrician to provide additional power sources commensurate with package needs. Agreements are made under the assumption that adequate power supplies and receptacles are available. Let It Shine Exteriors is not responsible for any increase in the customer’s utility bill.

6) Work stoppage

If the situation can be remedied on the job by the contractor, he will do so with the customer’s consent and a signed waiver. Full access is required on the day(s) of the service. Should partial access on the scheduled day(s) reduce the extent of the installation, we reserve the right to charge 100% of the scheduled installation. The customer acknowledges that Let It Shine Exteriors fills their schedule well in advance and schedules could change due to weather or elements beyond our control.

7) Weather & Rescheduling
Weather and employee health conditions are an important factor in our work environment and may prevent us from performing service on the scheduled date and time. We try our best to keep re-scheduling and scheduling conflicts to a minimum; however, we may need to reschedule work due to rain, wind, lightning, other weather-related conditions, and even employee health conditions that arise and are beyond our control. You will be promptly notified of any such changes. Every effort will be made to have the lighting display functioning by the agreed upon installation date; however, Let It Shine Exteriors is not responsible for delays out of our control and will attempt to reschedule all delayed installations to the next available date.

8) Takedown & Storage
We will make every effort to return in the month of January to takedown and remove the specified installed lighting and decorations, unless otherwise noted. Removal and storage of the specified lights and decorations are included in the installation price.

9) Liability
The customer agrees to defend and hold harmless Let It Shine Exteriors, its officers, and employees from and against all claims, liabilities to any third parties for injury, death, or damage to person, property, or loss arriving from installation, maintenance, or takedown unless such damage or loss is a result of gross negligence of Let It Shine Exteriors. You must ensure that all items and structures in and around the areas to be serviced are structurally sound prior to our arrival. We are not responsible for aged, weathered, or prior damage. By agreeing to have the service scheduled, you are ensuring all items are in good condition. Let It Shine Exteriors is not responsible or liable for damages caused by loose, cracked, opened, un-removed, unprotected, broken, faulty, defective, aged, weathered, rotting, damaged, or malfunctioning foundations, walls, roofing, framing, siding, gutters, fascia, soffit, doors, garage doors, windows, fans, electronics, plants, grass, furniture, seals, weather stripping, gaskets, drywall, trim, framing, flashing, caulking, plumbing, electrical sources, receptacles, switches, fixtures, fans, any type of wiring, HVAC, carpentry, paint, stain, sealant, etc. Also included are their associated items/objects such as hardware, accessories, attachments, materials, equipment, machinery, instruments, mechanisms, tools, appliances, or devices. We are not liable for any consequential or incidental damage, or for any loss resulting from defects as noted.  

10) Conditions
There is no way to completely prevent GFCI outlets from tripping when lights get wet although adequate preventive measures will be taken. The customer is responsible for resetting all tripped GFICs once the lighting display has dried out. We ask that irrigation systems be scheduled to function when lights are not in operation.

No maintenance will occur after 5:00pm central time December 23. A $100 trip fee per occasion may apply for maintenance calls where no manufacture or workmanship negligence is determined to be the cause of the issue. No third parties may interfere or tamper with the lighting display outside of the electrical outlet in use, which includes unplugging lighting display and accessories, or plugging in extra decor or accessories.

Let It Shine Exteriors is not responsible for any products damaged or lost due to vandalism, weather conditions, acts of God, or third parties and will make efforts to replace any damaged product for an additional charge. No warranty or complimentary repair service is expressed or implied, unless noted in writing in this agreement. Let It Shine Exteriors will replace any malfunctioning product but does not guarantee that each individual bulb will light for the entire installation period. Let It Shine Exteriors is not responsible for pre-existing conditions to roof, plants, gutters, etc.

You give Let It Shine Exteriors permission to modify any structure or surface of your property during and/or after installation, in which such modifications could result from (but not limited to) the use of tools, screws, nails, wire, hot glue, and staples.  

11) Safety and Courtesy
While Let It Shine Exteriors is on-site, you are responsible for keeping yourself, children, other individuals, and animals away from the work areas and off the work surfaces. Do not open doors, garage doors, or windows while we are working.

12) Photos and Video Footage
You give Let It Shine Exteriors permission to use any photos and video footage of the areas we provide service for the purpose of advertising and marketing. This includes using the photos and/or video footage on the internet, social media, and our website.

13) Promotions and/or General Information
By providing Let It Shine Exteriors personal information (name, address, phone number, email, etc) for your anticipated or chosen service, you agree to us mailing or emailing you to inform you of various offers we are promoting, or general information we deem fit to share with you.

14) Questions, Concerns, Complaints, Disputes, and Issues
Your satisfaction is important to us. If any questions, concerns, complaints, disputes, or issues arise after our service(s) are performed, please contact us via phone or email. All disputes are covered by Florida law and under the jurisdiction of Escambia County Courts only.

15) Change to Terms and Conditions
Let It Shine Exteriors reserves the right to change the Terms and Conditions at any time without notice.

16) Agreement
The agreement contains a complete statement of all terms of the agreement between both parties, which superseded all previous agreements and cannot be changed or modified except by written agreement by both parties. If any of the provisions of this agreement are found or deemed by a court of competent jurisdiction to be invalid or unenforceable, they shall be considered servable from the remainder of this agreement and shall not cause the remainder to be invalid or unenforceable.

If a dispute arises out of this agreement, the parties shall agree to resolve this dispute through arbitration in Escambia County before a single arbitrator. Any judgement upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The prevailing party in arbitration shall be entitled to its reasonable attorney’s fees and costs.

By signing or otherwise evidencing your acceptance of service with Let It Shine Exteriors, you agree to the terms and conditions of this agreement and accept this proposal on those terms. Furthermore, you declare that you are authorized to sign and/or accept this document, either as an owner of the property, or as an agent for the owner or entity. 

Signature

By signing this agreement (which includes all estimates, quotes, proposals, and work orders) I, the customer, agree that I have read and understand these terms and conditions which are applicable to all contracts.

No changes, cancellations or warranties to this contract are valid without being added separately in writing via a change order and signed by both parties.
